These Terms and Conditions ("T&C", "Agreement") govern your use of www.flightwiserclaims.com and services provided by Flight Wiser Claims ("Flight Wiser", "we", "us", "our"). By accessing our website, submitting flight information, signing an authorization, or using our services, you agree to be bound by these Terms.
1. Definitions
Agreement – the contract between the Client and Flight Wiser formed when the Client accepts these T&C and signs an authorization form.
Client / You – the individual submitting a flight claim.
Claim – any claim against a flight operating carrier (airline) for monetary compensation under applicable flight passenger rights laws, including EU Regulation 261/2004, UK261, or other relevant international or national regulations.
Flight Compensation – any monetary compensation received from an airline for a Claim, including all amounts recovered by Flight Wiser after signing the Agreement. Does not include legal fees or third-party costs incurred by Flight Wiser.
Assignment – the transfer of the Client's rights to Flight Wiser to pursue the Claim.
Legal Proceedings – any legal action, arbitration, or regulatory process undertaken to enforce a Claim.
2. Agreement & Authorization
- By signing the Agreement or accepting these T&C electronically, you authorize Flight Wiser to act on your behalf to pursue your Claim.
- You confirm that you have the legal capacity to enter this Agreement and, where applicable, act on behalf of other individuals (e.g., minors).
- You confirm that the Claim has not been previously assigned to another service provider or is not currently subject to legal proceedings.
- You agree to provide all necessary information and documentation, including boarding passes, booking confirmations, and identification.
- You agree not to accept any compensation directly from the airline without notifying Flight Wiser.
- Flight Wiser is authorized to receive all Flight Compensation on your behalf.
3. Pursuing the Claim
- You may submit flight data via the website, email, or other electronic solutions. Flight Wiser will assess the merits of the Claim.
- Assessment of your Claim is not a guarantee of success.
- Flight Wiser will negotiate with the airline to reach a settlement.
- If the airline refuses to satisfy the Claim, Flight Wiser may initiate Legal Proceedings at its discretion.
- Flight Wiser may engage external legal representatives, in which case you may need to sign additional agreements with them.
- If Legal Proceedings are deemed unlikely to succeed, you will be notified, and your Assignment rights return to you.
- Flight Wiser covers costs for Legal Proceedings initially; these costs are reimbursed from the Flight Compensation if successful.
4. Fees and Payment
- Flight Wiser operates on a 20% service fee of the Flight Compensation received.
- No compensation is due if the Claim is unsuccessful.
- Costs for Legal Proceedings not covered by the airline may be deducted from the Compensation, subject to prior notification.
- Payments will be made to the bank account provided by you. Any banking fees or international transfer costs will be deducted from your portion.
- If incorrect or incomplete bank information is provided, Flight Wiser is not liable for delays or losses.
- You must notify Flight Wiser immediately if you receive compensation directly from the airline; the 20% service fee remains payable within 10 business days.
5. Client Obligations
- You warrant that all information provided is accurate and complete.
- You agree to cooperate with Flight Wiser, including providing documents and responding to inquiries promptly.
- You shall not assign your Claim to any other service provider during the term of this Agreement.
- You must notify Flight Wiser immediately of any direct compensation or offers from the airline.
6. Termination
- The Agreement terminates automatically once the Claim is resolved and Compensation has been settled.
- Flight Wiser may terminate the Agreement if the Claim is deemed non-viable, or if you provide false or incomplete information.
- If you terminate the Agreement after work has commenced or Legal Proceedings have started, you may be liable for costs reasonably incurred.
7. Liability
- Flight Wiser is not liable for delays, non-payment, or outcomes outside of its control.
- Flight Wiser is not liable for lost bank transfers, prepaid cards, or incorrect bank information provided by the Client.
- You agree to indemnify Flight Wiser for any loss or damage caused by providing false or incomplete information.
8. Privacy and Data Protection
All personal data will be processed according to our Privacy Policy. By signing the Agreement, you consent to the collection, use, and international transfer of your data for the purpose of pursuing the Claim.
9. Intellectual Property
All website content, trademarks, and materials are owned by or licensed to Flight Wiser. You may not copy, distribute, or use any materials without prior written consent.
10. Governing Law and Dispute Resolution
- This Agreement is governed by the laws of the United Kingdom (or the jurisdiction where Flight Wiser is registered).
- Any disputes arising from these T&C will be resolved through negotiation, mediation, or applicable courts.
11. Amendments
Flight Wiser reserves the right to update these Terms at any time. Changes take effect 7 days after notification via website or email. If you disagree with changes, you may terminate the Agreement within that period.
